It was reported by us in June 2016 that we were instructed to defend a Midlands based business against charges of Fraudulent Trading and various alleged offences under the Consumer Protection from Unfair Trading Regulations 2008 (CPUT Regulations 2008).

The Crown’s Case | Kangs Complex Fraud Solicitors

The Crown’s case concerned the operation of a slimming business asserting that our client carried on his business for a fraudulent purpose, namely to mislead customers, creditors and other persons regarding his identity, ownership of the slimming business and about the effectiveness of a device called a Home Use Ultrasound Cavitation device, which was sold as an aid to fat loss.

The Defence Case | Kangs Trial Preparation Solicitors

Trial was originally fixed for this Spring, by which time our client’s defence had been fully prepared.

A month before Trial, extensive discussions took place which resulted in the Crown agreeing  to  discontinue the allegations of fraud.

In return it was agreed that our client would provide:

  1. A written basis accepting the facts presented by the Crown but excluding those relating to fraud.
  2. Assurances as to his future conduct including a non-court undertaking under the Enterprise Act.

Accordingly, the Trial was vacated.

The Sentence | Kangs Trading Standards Defence Solicitors

As the result of the limited basis to which our client pleaded, he received nine months custody, suspended for 24 months.

In addition, he was ordered to undertake one hundred and fifty hours of Unpaid Work and pay £5,000 in Prosecution costs.
