Disclosure and Barring Service Victory | Kangs Solicitors
Following the submission of detailed representations to Greater Manchester Police, they have decided not to disclose information on our client’s enhanced Disclosure and Barring Service (‘DBS’) Certificate.
Background | Kangs Criminal Team
Kangs Solicitors were instructed to represent a medical doctor in relation to information the Police wanted to include on his enhanced DBS certificate.
The information related to sexual allegations made by two separate patients whilst he was working at two different hospital trusts.
Route to Success | Kangs Pro-active Criminal Team
This successful appeal concludes a long and difficult period for our client who has faced a Criminal trial before Manchester Crown Court, which resulted in his acquittal, internal investigations by two Hospital Trusts and two detailed investigations by the General Medical Council, which concluded that there was no case to answer.
Irrespective of the above, the Police still wanted to include the details of these allegations on our client’s DBS Certificate which, given his profession, would have had serious ramifications for his future employment prospects as a doctor.
Kangs Solicitors drafted detailed and extensive submissions challenging all aspects of the disclosure notice. This involved the application of a number of leading authorities in this niche area of law.
Delighted Client | Kangs Solicitors
Following the decision by Great Manchester Police not to disclose the information, our client said;
‘I would like to thank Kangs for your invaluable help in this matter following your detailed representations…I would definitely recommend Kangs without hesitation’
