Birmingham Coffee Shop in Food Hygiene Investigation

Share

Kangs Solicitors have been assisting a well-known Birmingham City Centre coffee shop business which has been under investigation by Birmingham City Council for failing to comply with two separate Hygiene Improvement Notices.

Further to his article posted to this site on 17th April, Cagin Husnu reports upon the successful outcome achieved.

The Circumstances | Kangs Environmental Health Defence Solicitors

Our client was facing potential Court proceedings for failing to comply with two Hygiene Improvement Orders which listed numerous specific issues to be addressed in order to render the premises to a level acceptable to the Food Standards Agency.

Environmental Health officers attended the premises on five occasions between August 2017 and March 2018 and, as the issues raised had not been actioned to a satisfactory level, our client was requested to attend for interview under caution.

Favourable Outcome Achieved | Kangs Food Safety & Hygiene Solicitors

Kangs Solicitors advised and assisted our client in satisfying all issues raised and prepared a detailed evidential bundle which was provided to the Environmental Health officers for the interview.

Following the interview, and subsequent re-visit to the business premises, the matter was satisfactorily resolved thereby avoiding the substantial costs of court proceedings, the stress that attaches to legal proceedings and the potential for a criminal conviction and substantial fines being imposed.

A cut-throat defence arises where, during criminal proceedings, a defendant gives evidence on his own behalf and which is not only likely to strengthen the prosecution case but is designed to damage a co-defendant’s case to the extent that it may go as far as blaming the co-defendant whilst endeavouring to exonerate himself.
