Amandeep Murria of Kangs Solicitors comments upon a recently reported case involving a Birmingham based restaurant fined £50,000 for serving food on ‘unhygienic’ wooden serving boards.

The Circumstances | Kangs Health and Food Hygiene Solicitors

Inspectors were initially called out to inspect the restaurant following a party which resulted in a number of people apparently suffering from food poisoning.

A number of issues were identified by the Inspectors which concerned:

  • the cleanliness of the premises, considered to be of a very poor standard
  • sanitising chemicals not being used in accordance with the manufacturer’s guidelines
  • the use of wooden serving plates considered to pose a major risk to health.

As a consequence, a Hygiene Improvement Notice was served but when the Inspectors returned two months later, it was discovered that the wooden plates were still being used.

The Court Proceedings | Kangs Health and Hygiene Defence Solicitors

In response to proceedings issued by Birmingham City Council, the restaurant pleaded guilty to continuing the use of the wooden plates in breach of the requirements of the Improvement Notice.

The Magistrates imposed:

  • a very substantial fine of £50,000
  • costs totalling £670 and a
  • £120 victim surcharge.

The Head of Environmental Health was quoted to have said:

‘It is completely unacceptable for businesses to put the health of people eating at their restaurants at risk “.
