Hefty Damages Imposed | Kangs Health and Safety Regulatory Solicitors

Two companies have received very substantial fines following the sad death of an employee as the result of being struck by a shovel loader.

The Circumstances | Kangs Health and Safety Experts

  • Mold Magistrates’ Court heard how in early 2017, the 29 year old worker was struck by a shovel loader whilst working at a Paper Mill.
  • An investigation carried out by the Health and Safety Executive found that there was no safe system in operation to segregate pedestrians and vehicles. Further, the investigations established that drivers had limited visibility when driving large shovel loaders.
  • Two companies were prosecuted for offences contrary to health and safety regulations namely sections 2(1) and 3(1) of the Health and Safety at Work Act 1974.

Section 2(1) of the Health and Safety at Work Act 1974 states:

it shall be the duty of every employer to ensure, so far as is reasonably practicable, the health, safety and welfare at work of all his employees’.

Both companies pleaded guilty and were both fined £350,000 and ordered to pay costs of £6,000 each.

HSE Inspector Mhairi Duffy said:

‘this death would have been prevented had an effective system for managing workplace transport been in place. This is a reminder to all employers to properly assess and apply effective control measures to minimise the risks from moving vehicles in their workplace.
