Successful Result At Derby Court | Kangs Criminal Defence Solicitors

Our client was charged under Section 4 of the Public Order Act 1986 with an alleged offence of using threatening behaviour with intent to cause fear of/provoke unlawful violence.

The altercation occurred on a public road, with a person known to our client, and was witnessed by a person who called the police.

At the police interview, our client, who was represented by a member of the Kangs Solicitors Police Station expert team, provided a detailed explanation of the events and denied any criminal activity on his behalf.

Despite his denial of any liability, our client was charged and appeared at Derby Magistrates’ Court with his co-accused.

Our client was represented by a member of the Kangs Solicitors Magistrates’ Court Team.

At the hearing, no indication was given in relation to our client’s plea and representations were made to the Crown Prosecutor expressing our concerns as to the strength of the Crown’s Case.

As our client’s co-accused elected for the matter to be heard at the Crown Court, and there was another charge in relation to possession of an offensive weapon, the case was committed to the Crown Court for trial.

Shortly before the next hearing at the Crown Court, Kangs Solicitors received a Notice of Discontinuance from the Crown Prosecution Service stating that a decision to discontinue the charges had been taken because “There is not enough evidence to provide a realistic prospect of conviction …”.

Obviously, our client was absolutely delighted with the outcome.
