The Insolvency Service | Director Disqualification

Frances Murray of Kangs Solicitors provides an update on an investigation by the Insolvency Service with a view to director disqualification proceedings.

Kangs Solicitors were recently  instructed by a former Director of a London based consultancy and marketing company.

It was believed by the Insolvency Service that our client may have had information concerning a company involved in the illegal sale of carbon credits in the City of London and that he may have acted in the management of that company.

Under section 235 of the Insolvency Act 1986, our client was compelled to attend for interview before the Official Receiver for questioning on all aspects of that company’s business.

Kangs were instructed to accompany our client at the Official Receiver’s interview where, following the discussions conducted, the Official Receiver accepted that our client was not a director or manager of that company.

Clearly, our client was delighted that this pro-active support removed the suspicions against him and it also negated the requirement to complete the extensive and time consuming Director’s Questionnaire with which he had been presented.
