Variation of Property Freezing Order (‘PFO’) |Kangs Solicitors

Share

Colin Parker reported on 28th July 2016 that Kangs Solicitors had been instructed by a client to seek a variation to a PFO whereby funds could be released from her frozen assets to enable her to properly instruct her legal team to defend her position against Civil Recovery Proceedings, which were expected to be issued by the NCA.

Successful Outcome | Kangs Financial Fraud Solicitors

After many months of detailed document preparation and perseverance for the client’s cause, her application resulted in a Consent Order being sealed by the High Court of Justice.

Effect of Variation | Kangs Civil Recovery Defence Solicitors

Our client is now able to fully instruct her legal team to defend the High Court proceedings which have now been issued against her in the knowledge that she has funds available to cover her costs.

Without this successful application, she would not have been able to defend herself to a level which would be remotely adequate.

A member of our client’s family stated:

‘I thank you sincerely for all your help Colin. I must stress to you that you have really helped both myself and my family’.

Access to Justice | Kangs Financial Crime Team

At Kangs Solicitors we have a team experienced in applying to set aside any PFO as well as submitting applications to vary a PFO as is necessary to enable a client to have access to justice.

A cut-throat defence arises where, during criminal proceedings, a defendant gives evidence on his own behalf and which is not only likely to strengthen the prosecution case but is designed to damage a co-defendant’s case to the extent that it may go as far as blaming the co-defendant whilst endeavouring to exonerate himself.
